This is the second outside colony I have encountered, and to beat all it was in my yard just above my hives. Found the queen, she was marked with yellow paint so she was definitely not any of my bees.

G3, ya said yellow dot. Do you mark Q's ? How far away from you are from other beeks ?
Have a friend beek with 18 hives, he's had 1 absconding hive that he knows for sure. But 2 this week with Q's that are not his (he caught both this week) is their such a thing as swarms this late or are they more or likely absconds ?

Swarms with pre-marked queens. :)

I mark queen every now and then, either red or white (those are the colors of paint pens I have for work).
Cut the comb off of the tree and put them into a nuc.
Went inside for a little while and when we came back out all of the bees were on the front of the nuc. Sat and watched them until the queen showed herself. Put her in a queen clip and placed her in the hive with the brood comb, scooped up a handful of bees and put them with her. They all ran back outside still fanning as hard as they could. Bizzybee saw thm take to the air in a swarm and land on a disc 20 feet away. Later I put the nuc with the queen still clipped under the small swarm.
We will see what they intend to do, I would say goners or scoop them up and do a combine.

I lost a yellow marked queen earlier this year. What does she look like? :D
